Terms and Conditions

Project Quotations

Project quotations are valid for 30 days from the date of the agreement. SomCom LTD reserve the right to re-evaluate a project if we determine that the scope of the project has been altered dramatically from that originally agreed. SomCom LTD will be compensated for time worked beyond the scope of this project within reason and will notify the client of this.

The client understands that if any alterations are made to the scope of the project during its execution and delivery then SomCom LTD reserves the right to alter the project fee accordingly. SomCom LTD will notify the client of this eventuality prior to carrying out such work. Such fee changes will be applied at the prevailing hourly or daily rate.

Payment Terms

A project fee will be divided into payments according to a schedule agreed between SomCom LTD and the client.

Failure to make the required payments in a timely fashion can hold up the progress of a project and impact development schedules and launch dates. All invoices issued by SomCom LTD state the terms of payment required for your project to progress.

The initial payment (deposit) must be received by SomCom LTD in order for any work to commence.

Final payments linked to project completion assume that SomCom LTD has completed the project as outlined in the project brief to the best of its ability. This does not include requirements delivered by third parties which are beyond the realistic control of SomCom LTD. This includes responsibilities of the client in providing information and materials as required to complete the project, the supply of any assets critical to the launch of the project, or the provision of services from a third party not directly associated with SomCom LTD.

Reproduction of work

SomCom LTD reserves the right to reproduce representations of the completed project for marketing purposes.

Rejection / Cancellation of work

The client shall not unreasonably withhold acceptance of, or payment for, the project. If, prior to completion of the project, the client observes any non-conformance with the project plan, SomCom LTD must be promptly notified, allowing for necessary corrections.

Rejection of the completed project or cancellation during its execution will result in forfeiture of deposit and the possible billing for all additional labour or expenses incurred. All elements of the project must then be returned to SomCom LTD. Any usage by the client of those project elements will result in appropriate legal action. The client shall bear all costs, expenses, and reasonable legal fees in any action brought to recover payment under this contract.

SomCom reserve the right to change these terms at any time without notice.

Somcom supports its code for 30 days after making it live. Any bugs found outside of this 30 day period will be charged for at our hourly rate.

SomCom's standard hosting contracts run on a rolling 12 monthly basis.

SomCom requires 3 months' notice in writing for the cancellation of all hosting contracts.

Unless notice has been received 3 months prior to the end of the contract period, the contract will be automatically renewed.

SomCom do not issue refunds or credits for contracts cancelled part way through the contracted period.
